PLEASE READ CAREFULLY
These Terms and Conditions explain how the Tertiary Transition Functional Profile service is delivered, what is included, what is not included, how information is handled, how Reports may be used, and the conditions for payment, Report access, follow-up, cancellation, refunds and permitted sharing.
Private clients accept these Terms and Conditions by making payment for the service or otherwise expressly confirming in writing that they wish to proceed.
NDIS-funded Participants accept these Terms and Conditions by signing the applicable NDIS Service Agreement and Consent Form.
1. Definitions
1.1 “Provider”, “we”, “us” or “our” means Tertiary Transition and/or Telehealth OT, operated by Tom Underhay, Occupational Therapist.
1.2 “Client” means the person receiving the Tertiary Transition Functional Profile service.
1.3 “Participant” means a Client who is an NDIS participant.
1.4 “You” means the Client, Participant, parent, Legal Guardian, Nominee or authorised representative, as applicable.
1.5 “Legal Guardian” means a parent or legal guardian with authority to consent where the Client is under 18 years of age or otherwise lacks capacity to provide consent.
1.6 “Nominee” means a person authorised to act on behalf of an NDIS Participant or Client where applicable.
1.7 “TTFP” means the Tertiary Transition Functional Profile service and resulting Report.
1.8 “TTFP-Adapted” means a disability-aware assessment pathway within the TTFP service that may be used where disability-related adaptive functioning is relevant to tertiary study or training planning.
1.9 “Readiness for Study” means Pillar 3 of the TTFP and the associated questionnaires and assessment processes used by the Occupational Therapist.
1.10 “Report” means the final written TTFP Report prepared by the Occupational Therapist.
1.11 “Nominated email” means the email address nominated to receive service correspondence, assessment instructions, payment or service documents and the final Report.
1.12 “Clinical record” means the records created and held in relation to the delivery of the service, including referral information, consent forms, correspondence, assessment information, questionnaires, results and the Report.
1.13 “Licensed copy” means a copy of the Report provided to you for permitted use under these Terms and Conditions. It does not transfer ownership of copyright or intellectual property.
2. Purpose and scope of the service
2.1 The Tertiary Transition Functional Profile is a clinician-led functional profile designed to support informed tertiary transition planning. It brings together assessment and questionnaire information across three pillars:

Readiness for Study
2.2 The TTFP is designed to support practical planning around tertiary study or training pathways, including university, TAFE, vocational training, apprenticeships or similar structured learning pathways.
2.3 The TTFP is intended to help Clients, families, Nominees, support networks, educational providers and other relevant stakeholders better understand factors that may influence career pathway fit, study participation, study sustainability and readiness for study.
2.4 The TTFP may identify patterns that support participation, areas that may create friction or increase load, and practical conditions or set-ups that may support planning, preparation and participation in tertiary study or training. These may include study environment, workflow, communication, participation, feedback, recovery, digital routines, transport, accommodation and other practical readiness considerations where relevant.
2.5 The TTFP may suggest practical conditions, strategies or arrangements that could be considered or trialled by the Client and relevant stakeholders. These are intended as planning considerations and should not be interpreted as prescribed interventions, therapy recommendations, funded support recommendations or requirements that another party must implement.
2.6 The TTFP is non-diagnostic and non-therapeutic. It does not replace medical, psychological, psychiatric, educational, functional capacity or other specialist assessment.
2.7 The TTFP is not a Functional Capacity and Support Needs Assessment. It is not a therapy plan, treatment plan, behaviour support plan, risk assessment, access audit or a Report prepared for the purpose of funding justification or support needs determination.
2.8 The TTFP does not recommend specific courses, education providers, occupations, employment pathways, treatment pathways, support worker hours, staffing ratios, supervision levels, personal care requirements, funded support amounts or NDIS funding outcomes.
2.9 The Report is intended for planning and support purposes only. It is based on information available at the time the assessment information is completed and the Report is prepared. Circumstances can change, and the Report is not a guarantee of admission, progression, course completion, academic performance, employment outcomes, wellbeing outcomes, funding approval or service access.
3. Fixed service model and assessment pathway selection
3.1 The TTFP is delivered as one fixed three-pillar service.
3.2 The assessment pathway used within the TTFP may vary depending on referral information, disability-related adaptive functioning, available supporting documentation and the Occupational Therapist’s clinical judgement.
3.3 Where disability-related adaptive functioning is relevant, the Occupational Therapist may utilise a TTFP-Adapted pathway within Pillar 2.
3.4 The Occupational Therapist determines the most appropriate assessment pathway within the TTFP. This does not change the fixed fee, scope or value of the service.
4. Readiness for Study scope clarification
4.1 Pillar 3 of the TTFP is titled Readiness for Study.
4.2 Readiness for Study uses questionnaire information to identify practical strengths, considerations and areas that may require further planning before or during participation in tertiary study or training.
4.3 The Readiness for Study questionnaires are broad and inclusive. They may consider areas such as organisation and planning systems, study set-up, daily routines, finances, digital confidence, health and wellbeing habits, attendance requirements, transport, accommodation considerations, safety, rights, self-management, caring responsibilities and the practical load of managing study alongside everyday life.
4.4 Where a response identifies an area that may affect readiness for study, the TTFP may discuss practical planning considerations, areas requiring preparation or strengthening, existing arrangements, practical strategies, environmental considerations, existing assistance arrangements or areas for further exploration.
4.5 Readiness for Study is not a Functional Capacity and Support Needs Assessment. The TTFP as a whole is not a Functional Capacity and Support Needs Assessment.
4.6 Readiness for Study is not designed to determine disability support needs, support worker requirements, support ratios, support frequency, supervision requirements, personal care requirements, funded support hours or NDIS funding requirements.
4.7 References to support, assistance, arrangements, planning, practical strategies, environmental considerations or areas requiring strengthening should be interpreted as tertiary transition planning considerations and not as recommendations for funded supports, support hours, supervision levels or disability support funding.
5. What the service includes
5.1 The TTFP service includes:
review of referral information
selection of the appropriate assessment pathway within the TTFP service
access to the required assessments and questionnaires
guided assessment instructions
review and interpretation of completed assessment information
synthesis of findings across the three pillars
preparation of the final TTFP Report
electronic issue of the Report to the Nominated email
written email follow-up for clarification of the Report within the stated follow-up period
5.2 The service includes clinical interpretation and Report preparation by an AHPRA-registered Occupational Therapist.
5.3 The service does not include a standard appointment with the Occupational Therapist. An appointment will only form part of the service where the Provider specifically determines that one is required or separately agrees to provide one.
6. What the service does not include
6.1 The TTFP service does not include:
diagnosis or diagnostic confirmation
therapy, treatment, counselling, coaching or ongoing advisory support
Functional Capacity and Support Needs Assessment
access audit
behaviour support planning
risk assessment
formal assistive technology assessment or prescription
medical, legal, financial, tenancy or educational advice
course, provider, occupation, employment or career pathway recommendations
communication with third parties on the Client’s behalf, unless separately arranged
support worker recommendations
support worker hours or ratios
supervision recommendations
personal care recommendations
NDIS funding recommendations or guarantees
additional letters, forms, reports or support documentation
6.2 Additional support letters, forms, reports, funding letters, stakeholder communication or third-party documentation are not included in the TTFP service. If an additional service is requested and accepted, its scope, fee and payment requirements will be confirmed before that additional service proceeds.
7. Service delivery model
7.1 The TTFP is delivered online.
7.2 There is no standard appointment with the Occupational Therapist required as part of the service.
7.3 Assessment instructions and assessment links are provided by email, and the Client completes the required assessments and questionnaires in their own time.
7.4 Some assessments or questionnaires may be completed by the Client. Others may require or allow input from a parent, Legal Guardian, Nominee, family member, support worker or another person who knows the Client’s day-to-day functioning, depending on the assessment pathway used and the instructions provided.
7.5 The Occupational Therapist reviews and interprets the completed assessment information and prepares the Report. The clinical value of the service is in the interpretation, synthesis and Report writing rather than a standard appointment.
7.6 Phone contact is not a routine part of the service. Email is the primary communication channel.
7.7 Phone contact may occur at the Provider’s discretion where clarification is required before the service proceeds or where a logistical issue cannot reasonably be resolved by email.
7.8 The TTFP is not an emergency or crisis service. If there is an immediate risk to safety, contact emergency services or relevant crisis supports.
8. Client, Legal Guardian, Nominee and consent arrangements
8.1 Where the Client is 18 years or older and has capacity to consent, the Client is generally the person who provides consent.
8.2 Where the Client is under 18 years of age, consent must be provided by a Legal Guardian.
8.3 Where the Client is an NDIS Participant and has a Nominee, Legal Guardian or authorised representative involved, that person may provide consent where legally authorised to do so.
8.4 Payment by another person or organisation does not automatically grant that person or organisation access to the Client’s information or Report. Access remains subject to the applicable consent arrangements and privacy law.
8.5 The Report will be issued to the Nominated email. You are responsible for ensuring that the Nominated email is accurate, secure, regularly monitored and authorised to receive the Report.
8.6 By proceeding with the service, you confirm that the information you provide is accurate and complete to the best of your knowledge.
8.7 You agree to notify us promptly of any change to consent arrangements, guardianship, Nominee status, NDIS plan status, contact details or other relevant circumstances that may affect the service.
9. Privacy and information handling
9.1 The TTFP requires us to collect, hold, use and store personal information and, where relevant, health information.
9.2 We handle personal information and health information in accordance with applicable privacy laws, including the Australian Privacy Principles.
9.3 Information collected may be used for:
administration and delivery of the service
referral review and assessment pathway selection
assessment and questionnaire administration
clinical review, interpretation and Report preparation
invoicing, billing and payment processing
communication with the Client, Legal Guardian, Nominee, Plan Manager, Support Coordinator or other authorised contact where required to deliver the service
secure issue of the Report to the Nominated email
9.4 Clinical records may include referral information, assessment responses, questionnaire results, correspondence, consent forms, service agreements, invoices and the Report.
9.5 Clinical records are stored in secure systems used for clinical practice, administration and document management.
9.6 Some platforms used in the service may include artificial intelligence or automated features as part of their functionality. Where such platforms are used, the Occupational Therapist remains responsible for reviewing, interpreting and finalising all Report content.
9.7 You may withdraw consent at any time. Withdrawal of consent may limit or prevent our ability to provide or complete the service. Any refund following withdrawal of consent after service commencement will be considered under section 17.
9.8 You may request access to personal information held in the Clinical record. Requests will be considered in accordance with applicable privacy laws and professional obligations.
10. Assessments, questionnaires, information requirements and delays
10.1 All required assessments and questionnaires must be completed before the Report can be finalised.
10.2 If required assessments, questionnaires, documents or responses are not received, Report preparation and delivery timeframes will pause until they are received.
10.3 If information is incomplete, inaccurate, withheld or changes after assessment information is submitted, this may affect the accuracy, usefulness or completeness of the Report.
10.4 Assessments and questionnaires are generally intended to be completed once as part of the service and will not ordinarily be re-administered unless we determine that a verified technical issue, Provider error or other exceptional circumstance affected valid completion.
10.5 We are not responsible for delays caused by incomplete referral information, delayed assessment or questionnaire completion, missing documentation, incorrect contact details, email delivery issues outside our control, delayed payment or other matters outside our reasonable control.
11. Report issue method
11.1 The Report is issued electronically to the Nominated email supplied as part of the referral or service agreement process.
11.2 The Report is issued as a Licensed copy for permitted use under these Terms and Conditions.
11.3 The Report includes identifying information, date of issue, copyright notices, confidentiality notices and standard footer notices.
11.4 The Report will not be issued until full payment has been received and cleared.
12. Permitted use and sharing
12.1 You may use the Report for the Client’s personal tertiary transition planning and support purposes.
12.2 You may retain and print the Report for personal planning and support purposes.
12.3 You may share the Report with nominated stakeholders involved in tertiary transition planning and support, such as family members, school staff, tertiary support staff, Support Coordinators, treating clinicians or other relevant support people.
12.4 Sharing must be proportionate and consistent with the purpose for which the Report was prepared.
12.5 Once you choose to share the Report with a third party, you are responsible for that decision and for taking reasonable steps to ensure that the third party understands the Report is confidential and is to be used only for its intended purpose.
12.6 The Report must not be shared publicly or distributed broadly.
13. Prohibited use, misuse and AI or automated use
13.1 The Report is provided as a Licensed copy for the Client’s tertiary transition planning and support purposes only.
13.2 Except for possession, printing, use and sharing expressly permitted under section 12, the Report must not be reproduced, adapted, redistributed, published or used to create templates, tools, frameworks, training materials, commercial documents or derivative materials without prior written permission.
13.3 You may use AI tools or automated tools for your own personal understanding of the Report, provided you accept responsibility for any privacy, confidentiality, data security or accuracy risks associated with doing so.
13.4 The Report, in whole or in part, must not be uploaded into artificial intelligence tools, automated analysis systems, machine learning systems, text and data mining tools or reference systems for the purpose of training, developing, benchmarking, improving, commercialising or supporting another product, service, tool, framework, model or dataset without prior written permission.
13.5 Misuse includes, but is not limited to:
posting the Report or any part of it publicly
sharing the Report through social media, websites, forums or large group chats
distributing the Report beyond relevant stakeholders involved in planning and support
copying, extracting, adapting or reusing Report content to create derivative templates, tools, frameworks or commercial documents
using the Report or its content to develop or support a competing service or product
removing, obscuring or altering copyright, confidentiality or footer notices
attempting to circumvent or defeat any document security measures that may be applied
13.6 Breach of this section may result in us taking reasonable steps to protect confidentiality and intellectual property, including requiring cessation of misuse, declining to provide duplicate copies or declining future services.
14. Follow-up questions and communication boundaries
14.1 Written follow-up questions are available by email for 14 days after the Report is issued.
14.2 Follow-up is limited to clarification of the Report as written, such as explaining wording, how sections relate or what the Report states in context.
14.3 Follow-up does not include new assessment, additional analysis based on new information, changes due to evolving circumstances, course or provider recommendations, communication with third parties, ongoing advisory support, therapy, coaching or further Report writing.
14.4 If you believe the Report contains a material error or material misunderstanding, you must notify us within the 14-day follow-up period. We will review the concern and, where we consider it warranted, may issue an updated Report.
14.5 After the 14-day follow-up period, no further follow-up or clarification is included as part of the service.
14.6 Email is the primary communication channel. We do not provide support through social media direct messages.
15. Fees, invoicing and payment
15.1 The fee for the TTFP service is AUD $1,255.
15.2 The fee is the same regardless of the assessment pathway selected within the TTFP service.
15.3 The TTFP is provided as one fixed three-pillar service. The pillars are not priced separately.
15.4 Payment arrangements and invoicing methods differ depending on whether the service is accessed privately or through NDIS funding.
15.5 For private clients, full payment must be received and cleared before the service commences. Payment is made using the payment method or payment link provided in the applicable Service Agreement and Consent Form or other service documentation.
15.6 For NDIS-funded Participants, payment and invoicing arrangements are set out in the applicable NDIS Service Agreement and Consent Form.
15.7 For both private and NDIS-funded services, the final Report will not be released until full payment has been received and cleared.
16. NDIS-funded services
16.1 Tertiary Transition currently accepts NDIS-funded referrals from self-managed and plan-managed NDIS Participants only.
16.2 Tertiary Transition is not a registered NDIS provider.
16.3 NDIS-funded services require a signed NDIS Service Agreement and Consent Form before the service proceeds.
16.4 NDIS funding, plan suitability and payment approval remain subject to the Participant’s plan, funding arrangements, Plan Manager processes and relevant NDIS requirements.
16.5 Tertiary Transition does not guarantee that the TTFP will be funded, approved, reimbursed or accepted under a Participant’s NDIS plan.
16.6 The Participant, Nominee, Legal Guardian, Plan Manager or other authorised representative is responsible for confirming that sufficient and appropriate funding is available.
16.7 Where the Participant is plan-managed, the invoice will be sent to the Plan Manager after the invoiced service has been delivered. The Participant remains responsible for payment if the Plan Manager, NDIS plan or funding arrangement does not cover the service.
16.8 Where the Participant is self-managed, the invoice will be issued to the Participant or nominated representative after the invoiced service has been delivered.
16.9 The final Report will not be released until the applicable NDIS invoice has been paid and the payment has cleared.
16.10 Where a Participant does not currently have a relevant employment, work or study-related NDIS goal, or requires supporting documentation when seeking funding, Tertiary Transition may be able to provide a support letter where clinically appropriate. A support letter is an additional service and must be separately accepted before it is prepared. The provision of a support letter does not guarantee addition of a goal, funding approval, reimbursement or payment.
17. Service commencement, cancellations, refunds and non-completion
17.1 The TTFP is a clinical assessment and reporting service involving third-party assessment and Report costs, assessment administration, review of referral and assessment information, clinical interpretation, synthesis and Report writing.
Private clients
17.2 For private clients, payment confirms acceptance of the service and authorises us to begin work specifically for the Client and to purchase or access the assessments, reports and other materials required to provide the service.
17.3 For private clients, the service commences when full payment has been received and cleared. Work specifically for the Client and any required third-party purchases may begin immediately after payment has cleared.
NDIS-funded Participants
17.4 For NDIS-funded Participants, signing the NDIS Service Agreement and Consent Form confirms acceptance of the service and authorises us to begin work specifically for the Participant and to purchase or access the assessments, reports and other materials required to provide the service.
17.5 For NDIS-funded Participants, the service commences when, after receiving the signed NDIS Service Agreement and Consent Form, we first:
begin work specifically for the Participant;
purchase or access a third-party assessment, report or assessment material;
issue assessment instructions, assessment links or questionnaires; or
otherwise make assessment materials available to the Participant.
Service commencement may occur immediately after the signed NDIS Service Agreement and Consent Form is received.
Cancellation and refunds
17.6 Fees are not automatically refundable for change of mind once the service has commenced.
17.7 If you cancel the service, withdraw consent or choose not to complete required assessments or questionnaires after the service has commenced, this may prevent the Report from being completed. Any refund will be considered having regard to:
work specifically undertaken for the Client;
non-recoverable third-party assessment, Report or material costs already incurred;
other reasonable costs already incurred in delivering the service; and
any rights or remedies available under the Australian Consumer Law.
17.8 If we are unable to deliver the service due to circumstances within our control, we will provide an appropriate remedy in accordance with the Australian Consumer Law. This may include a refund where required.
17.9 If events outside our reasonable control prevent or significantly delay delivery of the service, such as major technology outages, natural disasters, serious illness or other significant disruptions, we will take reasonable steps to resume or complete the service where possible.
17.10 If the service ultimately cannot be completed because of events outside our reasonable control, any refund will be considered having regard to work specifically undertaken for the Client, non-recoverable third-party costs already incurred, other reasonable costs already incurred in delivering the service, and any rights or remedies available under the Australian Consumer Law.
17.11 Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law.
18. Client responsibilities
18.1 You agree to provide accurate, complete and current information to the best of your knowledge.
18.2 You agree to complete required assessments, questionnaires, forms and information requests in a timely manner.
18.3 You agree to notify us promptly if information changes or if you become aware that information provided was inaccurate or incomplete.
18.4 You understand that assessments and questionnaires are generally completed once as part of the service, and that changes to information after submission may not result in re-administration or re-completion unless we determine that this is required.
18.5 You understand that the accuracy and usefulness of the Report depend on the quality and completeness of the information provided.
18.6 You are responsible for ensuring that the Nominated email is accurate, secure, regularly monitored and authorised to receive the Report.
18.7 You are responsible for deciding who you share the Report with after it has been issued.
18.8 You agree to use and share the Report only for the permitted purposes and in accordance with these Terms and Conditions.
19. Copyright, licence and intellectual property
19.1 Copyright in the Report and its original written content remains with Tertiary Transition and/or Tom Underhay.
19.2 You receive a limited licence to possess, print, share and use the Report for the Client’s tertiary transition planning and support purposes in accordance with sections 12 and 13 of these Terms and Conditions.
19.3 Except for possession, printing, use and sharing expressly permitted under sections 12, 13 and 19.2, no part of the Report may be reproduced, adapted, extracted, republished, commercialised or used to create derivative templates, tools, frameworks or commercial materials without prior written permission.
19.4 Assessment instruments, third-party reports, publisher materials and source materials remain the property of their respective rights holders.
20. Limitation of reliance
20.1 The Report is prepared for the Client’s tertiary transition planning and support purposes.
20.2 The Report is not prepared for legal proceedings, insurance purposes, medico-legal purposes, access audits, NDIS funding decisions, support needs determination, support worker allocation or personal care planning.
20.3 The Report may be shared with and considered by relevant stakeholders involved in tertiary transition planning and support. Any decisions made by third parties using the Report remain the responsibility of those decision-makers.
20.4 The Report should be read as a planning document, not a fixed determination of ability, capacity, eligibility, funding, support hours or future outcomes.
21. Complaints and feedback
21.1 If you have concerns about the service, please email us so we can attempt to resolve the matter promptly and fairly.
21.2 If your service is NDIS-funded and you remain dissatisfied, you may also raise concerns through the appropriate NDIS complaints pathway.
22. Changes to these Terms and Conditions
22.1 We may update these Terms and Conditions from time to time.
22.2 The version that applies to your service is the version in effect when you accept these Terms and Conditions under section 24.1.
22.3 A later update will not retrospectively replace the version accepted for an existing service.
23. Governing law
23.1 These Terms and Conditions are governed by the laws of Queensland, Australia.
23.2 The parties submit to the jurisdiction of the courts of Queensland, Australia.
24. Acceptance
24.1 You accept these Terms and Conditions:
for a private service, by making payment for the TTFP or otherwise expressly confirming in writing that you wish to proceed; or
for an NDIS-funded service, by signing the applicable NDIS Service Agreement and Consent Form.
24.2 By accepting these Terms and Conditions, you confirm that you have read and understood them and agree to be bound by them.
24.3 You also confirm that you understand the TTFP is a clinician-led functional profile for tertiary transition planning and is not a Functional Capacity and Support Needs Assessment, therapy plan, treatment plan, behaviour support plan, access audit or Report prepared for the purpose of funding justification or support needs determination.
